Health Care Expense Enforcement
*All Bills MUST be paid IN FULL before you start the Medical Enforcement process
- If your court order charges for Ordinary Medical, the uninsured medical expenses must exceed the Ordinary Medical Expenses of $200 per year per calendar year if you are the payee of support. Documentation of the Ordinary Medical Expenses must be included if not already in your file. You must request of the other party the payment of the uninsured medical expenses within 28 days of the insurer’s final payment.
- Once you have provided the other party with the above-mentioned information, you are required to allow the receiving party 28 days to pay you directly.
- The parent must complete a “Request For Health Care Expense Payment ” Form #1. The form must be sent to the payer, or “Obligor” so that (s)he has 28 days to pay expenses directly to the parent seeking reimbursement. You must attach legible copies of all bills that include the following: a. Date of service, b. Patient’s name, c. Type of service, d. Cost of service.
- If after 28 days you have not received reimbursement, or only partial reimbursement, you must complete the “Complaint For Enforcement Of Health Care Expenses ” Form #2. Expenses must be organized by date with the bills and proof of payments in the same order. Date and sign at the bottom and include copies of the bills and Form #1 previously sent to the Obligor, along with Form #2.
- The FOC will review for accuracy, and return if corrections need to be made. If completed correctly, the FOC will serve the Complaint on the other party, to which parties will have 21 days to object. If there is no objection, the amount will be added to the child support account, and collected. If there is an objection, a hearing will be set with the Judge or Referee.
Please note:
FOC can ONLY assist with the bills that date back one year from the date of service. A motion must be filed for all bills that were accrued more than a year ago.
Claims for less than $100.00 per child, per year, will not be processed pursuant to MCL 552.511a(1)(b). If by December 31st, you have not met this threshold, you may submit the complaint.
